The inconsistencies in the complaint-affidavit of Roxanne Cabanero who accuses Vhong Navarro of raping her


Another rape complaint was filed by a woman on Wednesday, February 19, against Vhong Navarro amid the controversy involving the actor-host and model Deniece Cornejo, who has accused him of sexually assaulting her.

The rape charge was filed around 4 p.m. at the Pasig City Prosecutor's Office by the alleged victim and her legal counsel, Atty. Virgilio Batalla.

"Ang biktima po ng rape ay may 20 taon para mag-file ng kaso. At ang kliyente ko ay 4 na taon lamang (pagkatapos noong nangyari), kaya hindi gaano katagal iyon. Lumapit po sa akin ang biktimang ito dahil siya ay nagkaroon ng lakas ng loob dahil sa mga nangyayari, iyong pangyayari na may nagsampa kay Vhong Navarro ng rape. Dahil nakita niya na puwede palang mangyari ito nang paulit-ulit sa ibang babae katulad niya."

Asked by host Kris Aquino how he came to be the alleged victim's legal counsel, Batalla said:

"Ako po ang chairman ng Lingap Pinoy Foundation na nagbibigay ng libreng abugado sa mga taong nangangailangan lalo na sa mga walang kakayahan."

Batalla named the victim as Roxanne Cabañero y Acosta.

The 24-year old woman is a graduate from a University in Cebu and has joined several pageants representing Cebu and her hometown Davao. She joined Miss Resorts World 2010 and Miss Bikini Philippines. Her supposed biggest pageant was Bb. Pilipinas 2011 if not for a controversy that led to her disqualification.

According to reports, Cabanero was disqualified from the roster of Bb. Pilipinas official candidates due to alleged nude photos which surfaced online. Cabanero has since denied that she was the girl in the controversial photo and even sought the help of NBI to identify the blogger who uploaded the photo.

In her sworn affidavit that she was raped by the It's Showtime host on the night of April 24, 2010. She also said that she met Navarro on the ABS-CBN noontime show when they guested as contestants of Slimmer's World Miss Bikini Philippines the same day.

According to Cabanero, a staff got her number for Navarro and later in the afternoon, she received a text message from the comedian who suggested that they meet at her hotel room in Pasig. However, Roxanne refused so Navarro picked her up at the hotel around 10:30 to 11:30 pm of April 24.

The rape, according to Cabanero, happened inside Navarro's car which was parked under a shaded tree a few meters away from the hotel. She said she can't leave the car even if she wanted to because she was afraid of Navarro and his bodyguards/driver who were just waiting outside.

Cabañero's version of events surrounding her alleged rape by Navarro four years ago came under fire Sunday after two sources contradicted some parts of her sworn affidavit.

Vice Ganda said he was in Island Cove, a resort in Cavite, on April 24, 2010, the same date that Cabañero claimed she was raped by the “It’s Showtime” host somewhere in Pasig City.

“Nung araw na nagpunta sila para mag-promote ng pageant [sa 'It's Showtime'], hindi ko na po 'yun naaalala. Nung nalaman ko 'yung date, ipinaalala ng mga tao na concert ko 'yun at guest ko sila Kean Cipriano and Vhong Navarro. Sa Cavite po ang leg ng concert ko na 'yun. Kung nagsisimula ng 9 p.m. maaaring matapos ako ng 12 midnight or baka mas mahaba pa.”

In Cabanero’s sworn affidavit, she mentioned that on the night of April 24, 2010, Navarro sent her a message suggesting that they meet at her hotel room in Astoria Plaza in Pasig City but she declined because she was with her fellow candidates.

The management of the hotel where Cabañero and the rest of the Miss Bikini Philippines candidates were supposed to have been checked in on the night in question denied that they housed the beauties almost four years ago.

Astoria Plaza project director Ric Valenzuela said the event was indeed offered to them but this did not push through.

“Actually that event was offered to us but unfortunately the event organizer was asking for too many rooms because of the candidates. We could not accommodate them all. We have limited rooms here. We declined the offer of the promotion.

“They decided to transfer to another hotel. We did the negotiations with the event manager but it didn’t push through… That one is confirmed because I was the one who negotiated for that. Confirmed na we declined because we cannot provide the rooms.

“We checked the database. These are the arrivals and guestings from April 22 to 25 para covered because we don’t know how many days. There was none. There was no Roxanne Cabanero.”
